Two men found dead in the wake of a lawmaker’s murder in Daraga, Albay

ALBAY, Philippines – Two unidentified men were found dead on Sunday morning (December 23) in the town of Daraga in the wake of the assassination of AKO Bicol Party-list Rep. Rodel Batocabe.

According to the initial police report verified by PSInsp. Richelle Balute, Punong Barangay Roberto Obispo informed the police through a phone call that dead bodies with gunshot wounds on different parts of the body were discovered at a wooden area in Purok 6, Barangay Gabawan.

Obispo said the villagers couldn’t be certain if the men were residents in the area. Investigation is underway and authorities are looking into the links between the two men’s killing to the assassination of Rep. Batocabe in the neighboring Barangay Burgos on Saturday (December 22).

Batocabe and his aide were shot at a gift giving event for senior citizens and persons with disability (PWD) in time for the yuletide celebration.

The two were pronounced dead on arrival at AMEC hospital in Legaspi City after sustaining multiple gunshot wounds. Lawmakers raised P30 million pesos reward for any information that will lead to the capture of Batocabe’s gunmen. – Marje Pelayo (with reports from Lea Ylagan)

Daraga Mayor Baldo jailed after surrendering over Batocabe slay

DARAGA, Albay – Daraga town Mayor Carlwyn Baldo is now detained at the Legazpi City Jail in Albay after surrendering to the court Friday morning over the murder of Ako Bicol Party-list Representative Rodel Batocabe and his police escort.

The Daraga Police said Baldo voluntarily surrendered to the Legazpi City Regional Trial Court Branch 10 four days after a warrant of arrest was issued against him.

Baldo was accompanied by his family and Lawyer Merito Lovensky Fernandez when he faced the court this morning.

The mayor eluded arrest on Monday when a police team went to his house twice to serve the warrant for his arrest.

Baldo has been tagged as the mastermind in the killing of Batocabe and his aide Police Senior Master Sergeant Orlando Diaz in a gift-giving event in Daraga on December 22, 2018. Six others were injured in the incident.

Members of the hit squad he allegedly contracted all pointed to Baldo as the brains behind Batocabe’s murder.

He is facing charges for murder and attempted murder. The court set his arraignment on May 30.

Meanwhile, the Batocabe family welcomed Baldo’s surrender and expressed gratitude to the police for tracking the mayor.

“We are very happy and grateful to the police, prosecutors and the RTC (Regional Trial Court) for their hard work in putting Mr. Baldo behind bars,” Atty. Justin Batocabe, the son of slain lawmaker, said in a statement.

“This does not hide the fact that he evaded capture for five days. We think our case against him is strong and his evasion adds strength to that as flight is an indication of guilt,” he added.

The widow of slain solon, Gertrudes Batocabe, has joined the Daraga mayoral race as a substitute candidate of her husband.

Incumbent Vice Mayor Victor Perete, who is also gunning for the mayoral post, has been designated officer-in-charge of Daraga, Albay per order of the Department of the Interior and Local Government. (with details from Allan Manansala)

Baldo asks Duterte, DOJ: ‘Review Batocabe slay case’

MANILA, Philippines – Daraga, Albay Mayor Carlwyn Baldo maintains his innocence in the killing of Ako Bicol Party-list Representative Rodel Batocabe.

In a press conference on Friday, Baldo appealed to President Rodrigo Duterte and Justice Secretary Menardo Guevarra to review the case and evidence presented, and to find the real perpetrators of the crime.

“Nananawagan ako sa ating mga kinauukulan lalo na higit sa ating Pangulong Duterte at sa ating Secretary of Justice Menardo Guevarra na basahin at rebyuhing mabuti ang kasong ito lalo’t higit ang mga nakalap na physical evidence ng PNP na tukuyin kung sino talaga ang mga taong nasa likod nito,” Baldo said.

Baldo is facing two counts of murder and six counts of attempted murder before the Legazpi City Regional Trial Court (RTC) in relation to the death of Batocabe.

Baldo was tagged as the mastermind in the killing of Batocabe who was shot dead while attending a gift-giving event for senior citizens in Daraga town last December 22, 2018.

His security detail, PO1 Orlando Diaz, also died in the incident.

Batocabe was eyeing the mayoral seat of Daraga in the 2019 polls prior to his assassination.

Baldo was arrested in January 2019 after unlicensed firearms were found inside his residence during a search operation.

He was later released after posting a bail of P3 million.

“Inosente po ako at wala po akong kinalaman sa nasabing kaso. Bilang pulitiko, di ko po kailanman naging gawain na gamitan ng puwersa ang aking mga katunggali,” he said.

(I am innocent and I am not involved in the said case. As a politician, I have never used force against my rivals.)

Baldo also said that those behind the crime wanted to get rid of him although he refused to divulge any name.

“Habang lumalapit ang election ay dumadami po ang intelligence report na nagsasabing may mga taong nais akong patahimikin,” he said.

Atty. Merito Fernandez, Baldo’s lawyer, also insisted that the case should have been dismissed because of numerous inconsistencies made by witnesses and evidence gathered by investigators.

Fernandez also pointed out that the autopsy report conducted on Batocabe’s body does not match the testimony given by the alleged gunman, Henry Yuson, who said he shot the late lawmaker four times.

Yuson and four others, namely Christopher Naval, Jaywin Babor, Rolando Arimando and Emmanuelle Roselle were also charged with murder and attempted murder over Batocabe slay. – Robie de Guzman

Pistol used in Batocabe slay recovered from fishpond in Ligao City, Albay

Authorities have found ‪the caliber .45 gun that Henry Yuson allegedly used to assasinate AKO Bicol Partylist Rep. Rodel Batocabe. It was recovered from a fish pond in Ligao City, Albay. The gun was purportedly thrown into the water by another suspect, Christopher Naval alias “Tuping”.

MANILA, Philippines — The Philippine National Police (PNP) recovered the .45 calibre pistol which jammed on the day of the killing of Ako Bicol Party list Rep. Rodel Batocabe.

The weapon, issued to gunman Henry Yuson alias Henry, was handed over by Yuson to Christopher Naval alias Tuping who dumped the firearm to a fishpond located at Purok 3, Barangay Busay in the municipality of Ligao, Albay.

“According to the witness, ito ang ginamit ni Henry Yuson na nag-jam lang din kaya binunot niya ang caliber 40 na issued firearm niya,” explained Director PCSupt. Amador Corpus of the PNP Criminal Investigation and Detection Group (CIDG).

The firearm is undergoing ballistic and cross matching test by the PRO-5 Crime Laboratory.

Meanwhile, Corpus noted that PNP has already filed cases against the alleged mastermind in the case, Daraga Mayor Carlwyn Baldo following his arrest on Tuesday (January 23) for illegal possession of firearms.

Among the firearms recovered from Baldo’s residence were two .45 caliber pistols, ammunition for grenade launcher and Uzi rifle.

Baldo is now facing charges in violation of R.A. 10591 or the Comprehensive Firearms and Ammunition Act and R.A. 9516 or illegal possession of explosives.

Corpus hopes that the court will rule in their favor especially since the evidence match those from witnesses’ accounts.

“May violations pero disposition ng korte iyan. I hope there is a good disposition. The search warrant is implemeted properly,” Corpus said.

Baldo, meanwhile, is currently confined at UST Hospital in Legaspi City after complaints of hyperventilating on Tuesday evening.

“As per recommendation of the medical team ng Regional Health Service 5 dahil nagkaroon ng allergic reaction at tinamaan ng asthma niya dahil sa detention. parang sabi niya ay dahil sa amoy ng katol,” Corpus said of Baldo. — Marje Pelayo (with reports from Lea Ylagan)
