Paggamit ng pondo sa ilalim ng DAP, idineklarang unconstitutional ng Korte Suprema

MANILA, Philippines — Sa pamamagitan ng unanimous na botohan ay idineklara ng Korte Suprema na labag sa Saligang Batas o unconstitutional ang paggamit ng Administrasyong Aquino ng pondo sa ilalim ng Disbursement Acceleration Program o DAP at National Budget Circular Number 541.

Lahat ng labing tatlong mga mahistrado ay bumoto pabor sa desisyon na sinulat ni Associate Justice Lucas Bersamin habang nag-inhibit o hindi nakisali sa botohan si Associate Justice Teresita Leonardo De Castro.

Batay sa naging desisyon ng Korte Suprema, labag sa Section 25, Article 6 ng Constitution at sa Separation of Powers ang pagkuha ng pondo sa mga implementing agencies at pagdedeklara dito bilang savings bago pa man matapos ang taon.

Illegal din ayon sa Korte Suprema ang paglilipat ng savings o pondo mula sa executive department patungo sa ibang mga ahensiya ng gobyerno labas sa executive department.

Halimbawa nito ang pagbibigay ng palasyo ng 50-million pesos sa bawat senador matapos ang impeachment trial ni dating Chief Justice Renato Corona.

Illegal din at labag sa Saligang Batas ayon sa Korte Suprema ang paglalaan ng pondo sa mga proyektong wala sa National Budget na ipinasa ng Kongreso.

Pinawalang-bisa din ng Korte Suprema ang paggamit ng unprogrammed funds dahil sa hindi pagsunod sa mga kondisyon ng General Appropriations Act.

Samantala, sa kabila ng pagdedeklarang illegal ang paggamit sa DAP, walang binanggit ang Korte Suprema kung dapat managot dito sina Budget Secretary Butch Abad at si Pangulong Aquino.

Ngunit ayon sa ilang mga petitioner laban sa DAP, hindi pwedeng walang mananagot dito sa sinasabi nilang paglustay sa kaban ng bayan.

“Kung illegal ang DAP, kung mayroong maling ginawa, hindi naman uubra na walang mananagot para dito. So ang tinatanong natin at hinihintay natin ano ang pananagutan ni Sec. Butch Abad, ni Pangulong Aquino dahil hindi kami naniniwala in good faith nangyari ang lahat ng ito”, saad ni Bayan Secretary General Renato Reyes.

“Kailangang palalimin, kailangang pag-aralan kasi ang mga mamamayan, kapag pinag-usapan ang pondo ng bayan, ang concern niyan kapag may naglustay, kailangang papanagutin yung mga sangkot at yung pondo na nilustay ay ipakita at ilantad kung sino talaga ang may pananagutan at lapatan ng karampatang kaparusahan”, Gabriela Party-List / Petitioner vs. DAP Representative Emmi De Jesus.

Pero sa ngayon ay hihintayin muna ng mga petitioner ang kabuuan ng desisyon ng Korte Suprema at aaralin ito kung ano ang susunod na magiging hakbang nila. (Roderick Mendoza, UNTV News)

Supreme Court Chief Justice Peralta wants probe on ambush of CamSur Judge

MANILA, Philippines – Supreme Court Chief Justice Diosdado Peralta has called on law enforcement agencies to immediately investigate and arrest those behind the attack on a Camarines Sur Regional Trial Court judge and her aide that left them injured.

“I strongly condemn the recent attack on Judge Jeaneth Gaminde-San Joaquin of Libmanan, Camarines Sur and her companion. I urge all law enforcement agencies to immediately investigate the matter and ensure that the perpetrators of this crime are apprehended,” Peralta said in a statement posted on Twitter.  

“An attack on our judges is an assault on the Rule of Law. This has no place in a civilized society like ours,” he stressed.

An initial police report showed that Camarines Sur Regional Trial Court Branch 26 Judge San Joaquin and a member of her staff, Rocelle Martinez were aboard their vehicle going to Naga City when they were attack by two unidentified gunmen.

The incident occurred on the afternoon of Oct. 20 in Barangay Puro Batia in Libmanan, Camarines Sur.

The two sustained injuries and were taken to a hospital for medical treatment.

Set aside politics, prioritize the national budget, Palace tells lawmakers

Malacañang reiterated President Rordigo Duterte’s appeal to lawmakers to set aside politics and focus on the passage of the proposed 2021 national budget.

Presidential Spokesperson Harry Roque said the President wants the national budget to be sorted out since the row for the House leadership is affecting passage of the budget.

“Wala pong tigil ang pulitika diyan sa Kamara, gusto lang pareho maging speaker. Paano naman ang bayan? Wala po siyang pinapanigan, ang gusto lang niya maipasa ang COVID-19 budget na nasa loob po ng proposed 2021 budget, (The politics in the House is non-stop. Both parties want to become House Speaker. What about the nation? [The President] is not taking any sides, he just wants the passage of the COVID-19 budget which is under the proposed 2021 budget),” Roque said.

Duterte already ordered a special session period from October 13 to October 16. Roque also said the President hopes that the proposed national budget will be approved on the third and final reading in the Lower House during that special session period. AAC (with reports from Rosalie Coz)

Drilon recommends special session in November for national budget approval

Senate Minority leader Senator Franklin Drilon is appealing for a special session in November to assure passage of the 2021 national budget by the end of the year.

The session in Congress will suspend on October 17. Drilon said the national government should not operate under a reenacted budget especially when the country is still dealing with the coronavirus disease (COVID-19) pandemic.

The Senator said with the special session, Congress will be able to submit their version of the proposed budget by December.

“We will debate on the budget from November 9 to 13. We can finish it within five to seven days and allot two weeks for the bicameral conference. Congress can send to Malacanang the 2021 GAA by the first week of December so that the President can sign it before January 1, 2021,” he said.

Senate President Vincente Sotto III, meanwhile, is optimistic that there will be no reenacted budget as long as the Senate and the House of Representatives will do their jobs. He also agreed with Senator Panfilo Lacson on recommending the early resumption of the session in November for the deliberation of the national budget. AAC (with reports from Harlene Delgado)
