BULACAN, Philippines — Naghahanda na ang Bulacan Regional Trial Court sa posibleng pagdadala kay Retired Major General Jovito Palparan upang basahan ng sakdal

Ito ay matapos mahuli sa Sta. Mesa, Manila ang  isa sa tinaguriang Big 5 Most Wanted Fugitive sa madaling araw nitong Martes.

Pinapahintulutan pumasok ang mga mamahayag subalit hindi maaring kumuha ng video sa loob ng court room.

Ayon kay Atty. Melba Agustin  Branch 14 Clerk of Court, wala pang abiso kung ngayon araw dadalhin dito sa RTC si Palaparan, ngunit inihahanda na nila lahat ng mga kakailanganing papeles at iba pang bagay kung sakaling dalhin na rito ang akusado.

Hawak dati ni Atty. Narzal Mallares at Atty. Jesus Santos ang kaso ni Palparan.

Subalit ayon kay Santos, matagal na niyang hindi nakakausap si Palparan at hindi rin niya tiyak kung siya pa rin ang hahawak ng kaso nito.

Court finds Jovito Palparan ‘guilty’; sentences life imprisonment

BULACAN, Philippines –  The Malolos Regional Trial Court Branch 15 has found retired Major General Jovito Palparan “guilty” of kidnapping and serious illegal detention of two University of the Philippines (UP) students Karen Empeño and Sherlyn Cadapan.

Judge Alexander Tamayo sentenced Palparan, known as “The Butcher,” to a life imprisonment for the crime that sent families into 12 years of torment.

“Tama lang na mabulok ka sa bilanguan. Hindi pa po tama iyan. Kung ako ang magpapasya ay babalatan kita ng paunti-unti kagaya ng mga ginawa mo sa mamamayan,” said Erlinda Cadapan, Sherlyn’s mother.

“Tama lang managot si Palparan at dapat lang ilitaw si Karen Empeño at Sherlyn Cadapan,” said Karen’s mother, Connie Empeño.

“Simula palang ito. Simula pa lang ng laban. Ilabas nila ang katawan ng kapatid ko na buhay. Ilabas nila ang kapatid ko, ilabas nila,” exclaimed Sherlyn’s sister, Pamelyn.

The Court also ordered Palparan to pay a total of P600,000 to both of the victims’ families.

It was on July 26, 2006 when alleged student activists Empeño and Cadapan were abducted while doing a research in the town of Hagonoy in Bulacan.

According to the crucial witness, farmer Raymond Manalo, the two were tortured and sexually molested inside a military cell at the 24th Infantry Batallion in Limay, Bataan sometime in November 2006.

Manalo, along with his brother, Reynaldo, testified that they were abducted on February 14, 2006, in San Ildefonso, Bulacan, for being suspected as members of the communist group.

He said they were kept, along with the two students, by their military captors in captivity even during camp transfers.

He said he last saw the Empeño and Cadapan in July 2007.

Also found guilty were two of Palparan’s co-accused Lt. Col. Felipe Anotado and Staff Sgt. Edgardo Osorio.

Malacañang, meanwhile, through Presidential Spokesperson Harry Roque said: “We respect the decision of the court. We want justice to be done for the victims.”

Palparan is likely to be cited in contempt for badmouthing Judge Tamayo inside the courtroom after the verdict was read.

But the retired general remained firm.

“Hindi sya matinong judge. Go ahead, kung ma-contempt nila ako, go ahead.  Ano pa (kung) makukulong na ko ng for life”” the embattled retired army official said.

The court also ordered the transfer of Palparan to a regular prison cell from its temporary jail at the Philippine Army Headquarters.

Meanwhile, Judge Tamayo also issued a warrant of arrest against Palparan’s co-accused Master Sergeant Rizal Hilario who remains at large to date. – Marje Pelayo (with reports from Nestor Torres)

 

 

CA affirms indictment of Gen. Palparan

MANILA, Philippines – The Court of Appeals has affirmed the indictment of retired Major General Jovito Palparan, Jr. over the abduction of UP students Sherlyn Cadapan and Karen Empeño in 2007.

The CA Fourth Division dismissed Palparan’s appeal asking for the reversal of the orders issued by Malolos Regional Trial Court (RTC) directing his arrest for kidnapping and serious illegal detention.

The court said the RTC’s decision on Palparan’s motion to quash is not appealable based on the previous rulings of the Supreme Court.

Palparan is currently detained at Camp Aguinaldo while undergoing trial at the Malolos RTC. – UNTV News & Rescue

MANILA, Philippines – Pinabulaan ni retired Major General Jovito Palparan ang mga akusasyon ng isa sa mga saksing iniharap ng prosekusyon sa umano’y pagdukot at pag-torture sa dalawang estudyante ng UP na si Karen Empeño at Sherlyn Cadapan.

Nitong Lunes ay iniharap ng prosekusyon sa sala ni Judge Teodora Gonzales ng Malolos Regional Trial Court Branch 14 ang testigong si Raymond Manalo para sa kasong kidnapping at serious illegal detention laban kay Palparan.

Ayon kay Manalo, dinukot siya ng umano’y mga cafgu at ilang myembro ng 24th Infantry Batallion nang mapaghinalaang miyembro ng NPA noong March 2006 sa Barangay Buhol Mangga, San Ildefonso, Bulacan.

Dinala umano siya sa Fort Magsasaysay sa Nueva Ecija at doon pinahirapan sa pamamagitan ng pagpaso ng sigarilyo, pagpalo ng baril at binuhusan ng gasolina upang sunugin.

Hindi umano natuloy ang pagsunog dahil sa isang tawag ng isang babae upang sabihing ihaharap siya sa kanilang boss.

Mayo noong 2006 nang dalhin siya sa isang basketball court sa Barangay Sapang, San Miguel, Bulacan at doon niya nakita ang sinasabing boss na si General Jovito Palparan.

“Malilinaw sinabi ko at malalaking kampo pinagdalhan sa amin, di naman kampo ng NPA ang Kampo Tecson at Forth Magsaysay, Nueva Ecija. Siyempre pasisinungalingan niya yun dahil iyun totoo dahil kung di nya ako nakausap, di ko alam yung 1500 at binigay sa aking gamot na alive,” pahayag ni Manalo.

Matapos ang pag-uusap ay dinala umano silang magkapatid sa Camp Tecson sa San Miguel, Bulacan noong August 2006 at doon niya nakita at nakausap sina Sherlyn Cadapan, Karen Empeno at Manuel Merino.

Dito umano ginahasa si Sherlyn ng isang Seargeant Donald Cagas, ang leader ng 24th Infantry Battalion.

November 22, 2006 naman nang dalhin silang lima sa Limay, Bataan matapos na mahulihan ng sulat si karen para sa kanyang ina. Dahil dito muling isinalang sa torture si Karen.

Sa sumunod na mga araw, hindi na niya nakita si Karen at dalawa pa nilang kasamahan.

Itinanggi naman ni Palparan ang mga impormasyong isiniwalat ni Manalo sa korte.

Aniya, “May nakita kaming inconsistences, may mga idinagdag, na isa-subject namin sa scrutiny. Nakikita ko hindi makatotohanan mga sinabi ng witness nila hindi totoo in fact wala naman syang sinabi talaga na nagpakilala ako. Nakilala nya ako papaano nya ako nakilala hindi naman nya ako dating kilala hindi naman kami nagkita, yan mga tanung ko na itatanung din namin sa kanya. Retired na ako. Wala na ako talaga doon. Kung totoo yun, mukhang masyado naman yung kanyang testimony.”

Samantala, napaluha naman ang ina ni Karen Empeño matapos marinig ang salaysay ng isa sa mga saksi ukol sa sinapit ng kanyang anak sa kamay ng mga dumukot dito.

Panawagan nito na sana’y agad na makamit ang hustisya para sa kanyang anak

“Ang hapdi ng ginawa sa mga anak namin, hindi ko matangap,” ani Aling Concepcion Empeño, ina ni Karen.

“Si Palparan, makulong ma-convict at makamit ang hustisya aming inaasam,” saad pa nito.
