QUEZON, Philippines — Ipinasa na ng House Committee on Justice ang pangalawang impeachment complaint sa mahistrado ng Korte Suprema.
"The Committee on Justice finds probable cause to impeach Supreme Court Associate Justice Mariano del Castillo,” ani Rep. Niel Tupas Jr., chairman ng House Committee on Justice.
Sa botong 38-10, kumbinsido ang mga miyembro ng komite na may sapat na batayan o dahilan ang reklamo laban kay Associate Justice Mariano del Castillo.
Subalit bago pa man mag-umpisa ang pagdinig ay tinangka na itong harangin ng ilang mga kongresista dahil tapos na umano ang itinakdang 60 session days para resolbahin ang reklamo batay sa rules ng Kamara.
“The committee has lost its jurisdiction over the impeachment complaint against Associate Justice Mariano Del Castillo," ani Rep. Edcel Lagman ng Albay.
Nag-ugat ang impeachment complaint sa pangongopya o plagiarism di umano ni Del Castillo sa pagpapalabas ng desisyon sa kaso ng mga comfort women.
Ayon kay Congressman Tupas, bagamat hindi maituturing na high-crime ang plagiarism, nilabag pa rin ni Del Castillo ang batas at dapat niya itong harapin.
"It’s not a high crime but for the justice, even if there is no... assuming that there is no bad faith, for a justice to commit that error would tantamount or constitute of betreyal of public trust," paliwanag ni Tupas.
Agad namang ide-deretso ang impeachment complaint sa plenaryo upang doon gawin ang deliberasyon. Nangangailan ito ng 95 boto mula sa mga kongresista upang maiakyat naman ito sa Senado.
Tiniyak naman ni Congressman Tupas na sakaling makuha ng Kamara ang sapat na boto, hindi magkakasabay ang impeachment trial ni Del Castillo at ni Chief Justice Renato Corona, "ang preference ko ay tapusin muna yung Corona impeachment dahil tingin ko maximum of 2 months matatapos na rin yung Corona impeachment after that pagkatapos na ng Corona impeachment saka na lang i-transmit yung articles of impeachment, if ever, ng house kay Del Castillo. “
Naniniwala ang si Justice Committee Chairman Niel Tupas Jr. na malakas ang mga ibidensyang hawak nila laban kay Associate Justice Mariano Del Castillo at makukuha rin nila ang sapat na boto sa Kamara. (Ito Ang Balita ni Grace Casin, UNTV News)
